Welcome to The Rugby Factory (“TRF”, “the App”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the TRF mobile application and associated web services.

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility

1.1 Minimum Age

You must be at least 16 years old to create and operate an independent account.

By registering, you confirm that:

  • You are at least 16 years old; and

  • All information provided is accurate and up to date.

1.2 Guardian-Managed Profiles (Ages 13–15)

Players aged 13–15 (or aged 12 turning 13 within the current calendar year) may participate exclusively through a Guardian-Managed Profile, created and controlled by a parent or legal guardian aged 25 or older.

1.3 Children Under 13

Children under 13 are not permitted to use the platform in any capacity.

1.4 Age Misrepresentation

Providing false age information is a material breach of these Terms. We may suspend or terminate accounts where age misrepresentation is identified.

1.5 Age Verification

We reserve the right to request age verification at any time, including:

  • Date of birth reconfirmation

  • Credit card authorisation

  • Identity document verification

  • Other reasonable verification methods

Failure to comply may result in restrictions or termination.

1.6 Authentic Accounts

Accounts must be operated by real individuals. Automated, bot, impersonation, or fraudulent accounts are prohibited.

1.7 No Guarantee of User Accuracy

We cannot guarantee that all users provide accurate information and accept no liability for misrepresentation by users.

2. Account Responsibilities

2.1 Security

You are responsible for:

  • Maintaining login confidentiality

  • All activity under your account

Notify us immediately of unauthorised access.

2.2 Accuracy

You must keep your information accurate and current.

2A. Guardian-Managed Profiles

2A.1 Overview

Guardian-Managed Profiles enable youth participation under parental supervision until age 16.

2A.2 Guardian Requirements

Guardians must:

  • Be at least 25 years old

  • Hold an active TRF account

  • Complete SMS OTP verification

  • Confirm they are the legal parent or guardian

A Guardian may manage up to five profiles.

2A.3 Guardian Responsibilities

Guardians are solely responsible for:

  • Content posted

  • Privacy settings

  • Communications

  • Accuracy of information

  • Managing squad invitations and opportunities

2A.4 Minor Safeguards

Guardian-Managed Profiles:

  • Have no independent login access

  • Route all messaging to the Guardian

  • Exclude gym-based strength stats

  • Are not eligible for Team of the Week

  • Cannot participate in 1v1 comparisons

2A.5 Release at Age 16

Release requires:

  • Guardian SMS verification

  • Child email verification

Upon release:

  • Full control transfers to the child

  • Guardian access is permanently revoked

2A.6 Automatic Lock at 18

If not released by 18:

  • Guardian control ends automatically

  • Adult user may claim profile

  • After 12 months unclaimed, profile may be deactivated

2A.7 Safeguarding Enforcement

We may restrict accounts immediately where safeguarding concerns arise and may report serious concerns to relevant authorities where required or appropriate under law.

3. Acceptable Use

You must not:

  • Harass, bully, or discriminate

  • Post illegal or harmful content

  • Attempt to contact minors outside the platform

  • Groom, recruit, or exploit minors

  • Impersonate others

  • Misrepresent identity or age

  • Create automated accounts

  • Bypass commissions or fees

  • File malicious reports

4. User Content

4.1 Ownership

You retain ownership of your content.

4.2 Licence

You grant TRF a non-exclusive, worldwide, royalty-free licence to host, display, distribute, promote, and operate your content for platform purposes.

4.3 Responsibility

You are solely responsible for ensuring content is lawful and accurate.

We do not verify all user-submitted content.

4.4 False Content

False or misleading submissions may result in removal or suspension.

4.5 Promotional Use

We may feature publicly visible content in marketing materials. You may opt out by contacting [email protected].

5. Intellectual Property

All platform rights, including:

  • Software

  • Branding

  • Logos

  • Rankings systems

  • Algorithms

  • Databases

are owned by TRF or its licensors.

You may not reproduce, reverse engineer, or commercially exploit the platform without written consent.

6. Privacy

Your use of the App is governed by our Privacy Policy.

7. Paid Features

7.1 Premium Services

Certain features require payment.

7.2 Refunds

Payments are generally non-refundable except:

  • Where required by law

  • At our discretion

Nothing in these Terms excludes rights under the Australian Consumer Law.

8. Competitions & Promotions

Participation may be subject to additional rules.

9. Third-Party Services

We integrate with third-party services (e.g., Stripe, identity providers, social login). We are not responsible for their conduct.

10. Suspension & Termination

We may suspend or terminate accounts for breaches or safety concerns.

Where reasonably practicable, notice will be provided except where immediate action is required.

11. Disclaimers

The App is provided “as is”.

We do not guarantee:

  • Recruitment outcomes

  • Team selection

  • Sponsorship opportunities

  • Career advancement

  • Accuracy of rankings

  • Continuous availability

Statistics and rankings are indicative only and not professional advice.

12. Limitation of Liability

To the maximum extent permitted by law, TRF is not liable for:

  • Data loss

  • User conduct

  • Platform interruptions

  • Reliance on platform content

13. Indemnity

You indemnify TRF for claims arising from:

  • Your content

  • Your misuse

  • Your breach of these Terms

14. Reporting & Moderation

Users may report content or profiles.

We may:

  • Remove content

  • Restrict features

  • Require verification

  • Suspend or terminate accounts

15. Changes

We may update the App or Terms. Continued use constitutes acceptance.

16. Governing Law

Governed by the laws of New South Wales, Australia.

17. General

These Terms constitute the entire agreement between you and TRF.

If any provision is invalid, remaining provisions remain in effect.

We may assign these Terms in connection with a merger or acquisition.

We are not liable for events beyond our reasonable control.
